Terms of Service

These terms govern your use of Livemarks, private search for your X bookmarks.

1. Agreement to These Terms

By accessing or using Livemarks ("Livemarks," "we," "us," or "our"), you agree to these Terms of Service. If you do not agree, do not use Livemarks. Livemarks is operated by Thing In Itself, LLC, a Delaware limited liability company.

2. The Service

Livemarks helps you import, index, and search bookmarks from your X account. The service may include browser extension features, hosted search, media-derived indexing, AI-assisted search, account management, and related functionality.

Livemarks is not affiliated with, endorsed by, or sponsored by X Corp. or Twitter.

3. Accounts and Access

You sign in to Livemarks with your X account. You are responsible for maintaining access to your account, keeping your devices secure, and ensuring that you have the right to use any account or content you connect to Livemarks. You must be at least 13 years old to use Livemarks.

4. Plans, Billing, and Refunds

Livemarks offers free basic text search and a paid multimodal search plan. A paid plan is a one-time charge of $250 for one year of access. It does not automatically renew; access ends after one year unless you choose to purchase again. Payments are processed by Stripe, including through Stripe payment links, and Stripe handles your card details; we do not receive or store full card numbers. 5. Acceptable Use

You agree not to misuse Livemarks. For example, you may not:

  • Attempt to access another user's bookmarks or indexed data.
  • Reverse engineer, overload, interfere with, or abuse the service.
  • Use Livemarks for unlawful, harmful, or infringing activity.
  • Use Livemarks to collect or process data you do not have the right to access.
  • Interfere with the security or reliability of the service.

You are responsible for ensuring that your use of Livemarks complies with any terms, policies, or laws that apply to services or accounts you connect.

6. Your Content

Your bookmark library remains yours. You give Livemarks permission to process, store, index, display, and transmit your bookmark library and related data as needed to provide, secure, and improve the service. This permission continues for as long as needed to operate Livemarks or until the relevant data is deleted.

7. AI and Search Results

Livemarks uses AI and search systems to index content, generate media-derived text, and return results. Search results, captions, transcripts, summaries, and other generated outputs may be incomplete, inaccurate, or unavailable. You are responsible for how you use any results returned by Livemarks.

8. Privacy

Please review our Privacy Policy to understand how we collect, use, and protect information.

9. Intellectual Property

Livemarks, including its software, design, name, logo, and related materials, is owned by us or our licensors and is protected by applicable intellectual property laws. You may not use the Livemarks name or logo without permission.

10. Service Availability

We aim to keep Livemarks useful and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time.

11. Disclaimers and Liability

Livemarks is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Thing In Itself, LLC and its operators will not be liable for indirect, incidental, special, consequential, punitive, or similar damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of Livemarks.

12. Indemnification

You agree to indemnify and hold harmless Thing In Itself, LLC and its operators from claims, damages, losses, liabilities, and expenses arising from your use of Livemarks or violation of these terms.

13. Termination

You may stop using Livemarks at any time. We may suspend or terminate access if we believe you have violated these terms or may create risk for Livemarks, other users, or third parties.

14. Changes to These Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of Livemarks after changes means you accept the updated terms.

15. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Disputes will be brought in the state or federal courts located in Delaware, unless applicable law requires otherwise.
